Terms and Conditions (Terms)

This is a contract so please read the Terms carefully. This contract includes limitations of liability and of your rights and remedies.  If you do not agree to these Terms please do not enter the Promotion.

Who we are and how to contact us

The Promotion is operated by Positec Power Tools (Europe) Limited (“Positec”, “we”, “us”, “ours”). We are a company registered in England and Wales with registration number Our registered office is at Hill House, 1 Little New Street, London, EC4A 3TR.

The Promotion

The promotion (Promotion) is for a free Worx WA0194 Landroid Garage (Garage) when you make an eligible purchase of a Worx Landroid Robotic Lawn Mower (Landroid Robotic Lawn Mower).

The Garage is only available with a white canopy and silver structure. No other colours are available. Your Garage may vary slightly from those in any images. The packaging of the Garage may vary from that shown in images in stores.

The free Garage is limited to the first 150 successful entries to the Promotion

The Garage is not transferable and cannot be substituted for cash.

We do not accept any responsibility if you do not take up the Promotion.

How to enter the Promotion

The Promotion is being run at the following B&Q Stores: Hedge End, Nursling, Croydon, Portsmouth, Exeter, Nottingham, New Malden, Yeading, Coventry and Milton Keynes (Eligible Stores).

The Promotion is being run in the Eligible Stores from 12.00am on 16 October 2019 to 11.59pm on 31 October 2019 (Eligibility Window).

To be able to enter the Promotion you need to have purchased a Landroid Robotic Lawn Mower from an Eligible Store during the Eligibility Window.

To enter the Promotion you need to email a copy of the receipt of your purchase to ukmarketing@positecgroup.com within 28 days of making your purchase (Entry). Please make sure that the name of the Eligible Store and the date of your purchase are visible in your Entry submission.

If your Entry is successful, Positec will notify you of this by email, including details of when you can expect to receive your Garage.

Entries received outside of the Eligibility Window or more than 28 days after your purchase of your Landroid Robotic Lawn Mower are automatically disallowed, unless waived by Positec at its sole discretion.

Positec will not accept:

responsibility for Entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

proof of transmission as proof of receipt of an Entry by Positec.

By submitting an Entry you are agreeing to be bound by these Terms.

Eligibility

The Promotion is only open to individuals aged 18 or over.

The Promotion is not open to anyone who:

lives in Northern Ireland;

is an employee of Positec or its holding or subsidiary companies;

is an employee of agent or suppliers of Positec or its holding or subsidiary companies; or

is a member of the immediate families or households of the categories listed in clause 2 and clause 4.2.3.

The Garage will only be delivered to a UK mainland address. If you wish to have the Garage delivered to a different address, you will need to arrange for collection/onward delivery from the UK mainland address you have supplied to us.

The number of Entries to the Promotion is limited to one per household.

Agents are permitted to submit Entries on behalf of individuals providing they have the individual’s express written consent. Positec may require such entries to prove such written consent.

Positec will not accept Entries that are automatically generated by computer, are illegible, illegal, or have been altered, reconstructed, forged or tampered with.

Positec reserves all rights, at its sole discretion, to refuse Entries where there is any reason to believe that the entrant is in breach of these Terms.

Delivery

We will pay for the delivery costs of the Garage.

When we will provide the Garage. We will deliver the Garage to you as soon as reasonably possible, usually within 3-10 working days.

Positec is not responsible for delay outside our control. If our supply of the Garage is delayed by an event outside our control then we will contact you as soon as possible to let you know and will take steps to minimise the effect of the delay.

You will become responsible for the Garage from the time we deliver the Garage to the address you gave Positec.

If no one is available at your address we will leave you a note informing you of how to rearrange delivery or collect the Garage from a local depot, unless the Garage can be left securely at your address. If you do not rearrange delivery or collect the products from a delivery depot we will contact you for further instructions.

Quality

Positec warrants that on delivery the Garage shall:

conform with its description and any specification for the Garage;

be free from material defects in design, material and workmanship; and

be of satisfactory quality (within the meaning of the Sale of Goods Act 1979).

Subject to clause 3 if:

you give us notice in writing within a reasonable time of discovery that some or all of the Garage do not comply with the warranty set out in clause 1;

we are given reasonably opportunity of examining the Garage; and

you (if asked to do so by us) return the Garage to our place of business at our cost,

we shall, at our option, repair or replace the defective Garage.

We shall not be liable for the Garage’s failure to comply with the warranty set out in clause 1 in any of the following events:

you make any further use of the Garage after giving notice in accordance with clause 2;

the defect arises because you failed to follow our oral or written instructions as to the storage, commissioning, installation, use and maintenance of the Garage;

you alter or repair the Garage without our written consent;

the defect arises as a result of fair wear and tear, wilful damage, negligence, or abnormal storage or working conditions; or

the Garage differs from its description or specification as a result of changes made to ensure they comply with applicable statutory or regulatory requirements.

Except as provided in this clause 6, we shall have no liability to you in respect of the Garage’s failure to comply with the warranty set out in clause 1.

These Terms shall apply to any repaired or replacement Garage supplied by us.

Limitation of liability

Insofar as is permitted by law and save as set out in clause 6.2, Positec, its agents or distributors will not in any circumstances be responsible or liable to compensate you or accept any liability for any loss as a result of entering the Promotion.

Positec will only process your personal information as set out in the Positec privacy policy at http://worx-europe.com/en/privacy-policy/

General

Positec reserves the right to hold void, suspend, cancel, or amend the Promotion where it becomes necessary to do so.

These Terms are between you and us. No other person shall have any rights to enforce any of its Terms.

These Terms constitute the entire agreement between you and us.

If a court finds part of these Terms illegal, the rest will continue in force. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect

These Terms are governed by English law and you can bring legal proceedings in respect of the Promotion in the English courts. If you live in Scotland you can bring legal proceedings in respect of the Promotion in either the Scottish or the English courts.
